there is some game that has some things that look like too similar to tpt called modular spaceships and it uses tpt textures is it legal

TPT doesn't really have textures.
That said, it does have a distinctive style, but it would be OK to use things you've drawn in TPT elsewhere. Credit would be nice, although not required, and we definitely have no grounds to get apps like this removed (nor would I want to). -

As jacob1 mentioned above he has no wishes to get the game removed, while some credit would be nice. Doesn't mean he will/can get the game removed. TPT has no grounds to get this game removed, in my opinion it'd look bad for mods here to do so.
To do so would be over reach by the moderators. Unless it was a direct copy of TPT, then it would warrant removal, as mentioned someone asked to use these.

Someone else discovered that the sprites in Modular Spaceships are made in TPT
I did use TPT as a graphics editor to make sprites (because I still haven't mastered any other), and there are indeed a lot of TPT references in the game, so when the credits are added to MS, I'll make sure to mention TPT there. -
